Referral Program Terms

Participation and acceptance

The Giants Digital Referral Program permits eligible individuals and businesses to refer prospective website clients in exchange for a reward on a Qualifying Sale. Participation is free and does not require purchasing a website or recruiting other participants. By affirmatively accepting these terms during registration, you agree to this agreement. You must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater, have authority to enter this agreement, and be legally eligible to receive payment through PayPal in your country. If registering for a business, you represent that you are authorized to act for it.

You must provide your legal name, contact email, and complete and accurate postal address, including street, city, country, and applicable state or province and postal code. You must verify your contact email and connect a verified PayPal account that you own or are authorized to use and that can receive USD rewards. Email verification and PayPal connection are required to activate your referral link and code. Optional business name and phone details may be supplied. Only one participant account is permitted per person or business unless we authorize otherwise in writing. Registration remains subject to reasonable identity, fraud, and legal eligibility verification. We do not guarantee referrals, sales, or earnings.

Referral links and codes

Each verified participant receives a unique referral link and code. A valid code supplied by a prospective client before their order is accepted takes precedence over an automatically captured referral link. Otherwise, we attribute the referral to the first valid referral link captured during the 90 days before the client's initial inquiry. Attribution recorded on an inquiry follows the resulting order. The client may correct an attribution error before agreeing to the order.

Tracking can be affected by browser settings, consent choices, or use of another device. The prospect may enter your code instead. A referral code is an attribution identifier and provides no discount unless a separate written offer expressly states otherwise. We will review a supported attribution dispute against inquiry, order, and payment records and provide a written explanation of our determination. We will not knowingly deny a valid reward solely because our tracking failed where reliable records establish the referral before the order was accepted.

Qualifying Sales and reward amount

A "Qualifying Sale" is a new client's purchase of the Giants Digital website offer for $5,499 USD as a one-time website fee, together with enrollment in the required monthly managed hosting plan identified in the client's order. The referral must be recorded under this agreement before the order is accepted. The full $5,499 USD website fee and the first $129 USD hosting payment must have been successfully received and retained by Giants Digital, and enrollment in the $129/month managed hosting subscription must be verified. If the first hosting payment occurs later than the end of the website-payment holding period, the reward cannot become eligible before that hosting purchase is completed. The reward is $500 USD per Qualifying Sale, payable to the attributed participant only.

Clicks, registrations, inquiries, proposals, unpaid invoices, partial payments, hosting subscriptions or renewals, and unrelated services do not independently qualify. No reward is payable for referring yourself, your own business or an entity you control, an existing client buying the same offer again, a duplicate referral for an already attributed order, a fabricated client, or a fraudulent transaction. A prospect with an existing active website proposal from Giants Digital when the referral was made does not qualify, unless we agree otherwise in writing. Inclusion in a prospect directory alone does not constitute an active proposal. One qualifying client order earns one reward; the same sale cannot generate multiple rewards.

Holding period and payment

The 60-calendar-day holding period starts when Giants Digital successfully receives the full $5,499 website fee. Payment authorization, a pending transfer, or a deposit does not start the period. After 60 calendar days, the reward becomes eligible if the sale remains qualifying and the website payment has not been refunded, reversed, or disputed. We will send eligible rewards within 10 business days after eligibility and completion of required verification.

A timely pending client refund request, payment dispute, documented fraud concern affecting that sale, or missing legally required information may delay the affected reward. We will give notice of the reason, request only relevant information, and pay a reward that remains valid within 10 business days after the issue is resolved. Unrelated eligible rewards will not be held merely because another sale is under review.

Rewards are paid in USD to your connected, verified PayPal account. You are responsible for keeping that address accurate and for your account's ability to receive funds. We pay the sending fee; you bear separate conversion and withdrawal charges. Failed or returned payouts are not forfeited merely because the transfer failed. We will request corrected information and arrange a lawful retry. For unclaimed payouts, we will reconcile the original transaction and any return of funds before issuing another payment. PayPal's own processing and account restrictions may affect when funds are accessible.

Refunds and reversals after a reward is paid

If the underlying website payment is later refunded in whole or in part, reversed, charged back, or established to be fraudulent, the sale ceases to qualify and the associated reward is subject to recovery. We will explain the basis and amount in writing and allow you to raise a supported dispute. After any such dispute is resolved, you must repay an improperly paid reward within 30 calendar days of written demand, to the extent permitted by law. We may instead offset the undisputed amount against future rewards with notice. This clause does not authorize us to debit your PayPal account or another payment method without separate lawful authorization.

Promotion and disclosures

You must describe Giants Digital and the offer truthfully and clearly disclose your potential financial benefit wherever you recommend the offer or share a referral link or code. Suitable wording is: "I may receive $500 from Giants Digital if you purchase a qualifying website through my link or code." Put the disclosure with the recommendation so that readers can readily see it.

You must not send unlawful unsolicited messages, impersonate Giants Digital, fabricate reviews or personal experience, guarantee business results, misstate pricing or refund rights, use deceptive redirects or tracking, or offer unauthorized discounts. You may not make commitments, sign agreements, collect client payments, or represent yourself as an employee or authorized sales agent of Giants Digital. Sharing a referral is not permission to upload another person's private information without an appropriate lawful basis. Giants Digital may supply approved descriptions and request corrections to misleading promotions.

Taxes and personal information

You are responsible for taxes on rewards, subject to our applicable reporting and withholding obligations. We may request legally required tax or identity information through a secure process before payment. We use registration details, attribution records, and payout information to administer the program, prevent fraud, communicate about your account, and satisfy legal and accounting obligations, as described in our Privacy Policy. PayPal and any other necessary service providers process relevant information under their own applicable terms. The participant portal provides only information needed to track your rewards and does not grant access to private client records.

Changes and termination

We may change or discontinue the program prospectively by notifying participants. Changes to reward amounts or eligibility apply only to referrals first recorded after the stated effective date. Previously recorded qualifying referrals remain governed by the terms applicable when they were recorded, including their holding period, unless a change is required by law.

You may close your account by contacting us. We may suspend or terminate an account for a material breach, fraud, or legal ineligibility, with a written explanation where legally permitted. Termination or discontinuation does not by itself cancel legitimate rewards attributable to qualifying referrals recorded beforehand. Fraudulent or otherwise ineligible rewards remain subject to the rules above.

Relationship and governing law

Participation creates no employment, agency, franchise, partnership, or authority to bind Giants Digital. Neither party is responsible for the other's unrelated obligations. This agreement is governed by Florida law, and disputes will be heard in the appropriate state or federal courts serving Collier County, Florida, except where mandatory applicable law requires another law or venue.

If a provision is unenforceable, it will be limited to the extent legally necessary, and the remaining provisions remain effective. Nothing in this agreement excludes a right or remedy that cannot lawfully be excluded. These specific referral terms control over conflicting general website terms for this program. They do not govern the client's website refund rights, which are addressed in the Website Offer and Refund Terms.
